The new edition of the commentary on the Renewable Energy Sources Act (EEG), published on 30th May 2025, offers competent and reliable explanations of the provisions of the EEG for legal practice. The instructive scientific and technical digressions on the most important subsidised renewable energy technologies have been retained, as has the presentation of the construction law aspects of photovoltaic (PV) and wind energy systems.
The editors, Prof. Walter Frenz, Maitre en Droit Public and Professor of Mining, Environmental and European Law at RWTH Aachen University, Aachen/Germany, Prof. Hans-Jürgen Müggenborg, specialist lawyer for administrative law and honorary professor at RWTH Aachen University, Prof. Tilman Cosack, Professor of Environmental Economics and Environmental Law at Trier University of Applied Sciences, Trier/Germany, Prof. Marc Ruttloff, lawyer and partner at the law firm Gleiss Lutz in Stuttgart/Germany, and Prof. Thomas Schomerus, Professor of Public Law, in particular Energy and Environmental Law, at Leuphana University Lüneburg, Lüneburg/Germany, have completed the commentary on the EEG 2023 on 1,528 pages as of the end of 2024 and for the most part still include the legislative changes introduced by the EEG 2025.
The concept of the commentary has remained the same as the previous versions. On the one hand, this volume offers practical, immediately realisable solutions, while on the other hand, it shows the deeper background, in particular from Union and climate constitutional law. The latter will continue to shape the expansion of electricity generation from renewable energies. However, the EU level will issue guidelines that further develop the Green Deal Industrial Act, which will result in the new direction of EU energy policy. In addition, the USA’s withdrawal from the international climate agreement must be responded to. The commentary deals with the initial consequences in a related introduction, which also takes stock of the collapsed traffic light government.
A complex law requires a complex commentary for legal practice. The book offers a unique commentary as of December 2024, which combines practical solutions with the principles of EU and climate constitutional law for a holistic overview. From the perspective of a non-lawyer, the comprehensive index at the end of the work is an invaluable aid.
